1. Definitions

In these Terms:

  • Annual Licence means a Mooring Licence granted for one year payable in advance.
  • Annual Direct Debit Licence means a Mooring Licence granted for one year payable monthly by Direct Debit.
  • Short-Term Licence means a licence for less than one year.
  • Authorised Use means private leisure use only unless otherwise agreed in writing.
  • Company means Tingdene Marinas Limited and its employees and agents.
  • Marina means the marina premises and waters owned or operated by the Company.
  • Mooring means the berth allocated from time to time.
  • Mooring Licence Fee means the fee payable for the Mooring.
  • Owner means the person(s) signing the Agreement.
  • Vessel means the boat described in the Agreement including all equipment and contents.
  • Daily Rate means the published daily visitor mooring rate.

2. Use of the Mooring

2.1 Licence

The Company grants the Owner a licence to use the Mooring for the Mooring Licence Period for Authorised Use only.

2.2 No Tenancy

This Agreement creates a licence only and does not create a tenancy or confer exclusive possession.

2.3 Allocation

The Company may allocate or reallocate berths at its discretion.

2.4 No Assignment

The Owner may not assign, transfer, or sub-let the Mooring.

2.5 Absence

The Owner must notify the Company if the Vessel will be absent for more than 14 days. No refund is payable during absence.

2.6 Access

The Company may board, move, or enter the Vessel in an emergency or where reasonably required.


3. Consumers

Nothing in this Agreement affects statutory rights.


4. Prohibition Against Business Use

The Mooring may not be used for business or commercial purposes without prior written consent.


5. Company’s Liability

5.1 The Company is responsible for foreseeable loss or damage caused by its negligence.

5.2 The Company is not liable for:

  • Loss caused by events beyond its reasonable control.
  • Loss of profit, business, or indirect loss.
  • Theft unless caused by negligence.

6. Charges and Payment

  • Mooring Licence Fees are payable in advance.
  • Direct Debit payments must remain active.
  • Interest on late payments: 4% above Bank of England base rate.
  • The Company may detain or remove the Vessel for non-payment.

7. Owner’s Obligations

7.1 Insurance

  • Minimum £3,000,000 third-party liability insurance.
  • Policy must remain valid throughout the Licence Period.

7.2 Vessel Condition

  • Vessel must be seaworthy and maintained.
  • Proper mooring lines and fenders must be used.
  • Valid Boat Safety Certificate (if applicable).

7.3 Safety

  • Speed limit: 3 knots.
  • No refuelling outside designated areas.
  • Notify Company of hybrid/electric propulsion changes.
  • Comply with lithium battery safety requirements.
  • Maintain smoke and carbon monoxide alarms.

7.4 Conduct

  • No nuisance, harassment, or anti-social behaviour.
  • No storage of refuse on pontoons.
  • Pets must be controlled and cleaned up after.

8. Environmental

  • No discharge of sewage, oil, fuel, or waste.
  • Use pump-out facilities.
  • Conserve water usage.
  • Only smokeless fuel permitted.

9. Parking

  • Up to 2 motor vehicles per Vessel (subject to availability).
  • Vehicles must be roadworthy, taxed and insured.
  • Trailers subject to charge.

10. Electrical

  • Supply not guaranteed.
  • Owner responsible for safe connections.
  • Company may disconnect supply if unsafe or unpaid.

11. Change of Address or Vessel

The Owner must notify the Company immediately of any change of address or sale of the Vessel.

A commission of 1% + VAT applies to private sales completed within the Marina.


12. Termination

  • Annual Licence: 28 days written notice.
  • Direct Debit Licence: 6 months written notice.
  • Short-Term Licence: Non-refundable.
  • Immediate termination for breach or non-payment.

13. Rights of Sale, Detention and Removal

The Company may exercise a lien over the Vessel for unpaid sums and may sell or dispose of it in accordance with the Torts (Interference with Goods) Act 1977.


14. Miscellaneous

  • Services may be suspended for safety or emergency.
  • Data handled in accordance with Privacy Policy.
  • English law applies.
  • Harassment or abusive behaviour will not be tolerated.

Special Conditions

Racecourse Marina – Vessel must not be moved during horse racing events.
